Mississauga Condo Parking Spots, Lockers & EV Charger Rules (2026 Value & Legal Guide)
2026 Mississauga Condo Parking, Locker & EV Charging Legal Audit by Fernando Borges Mora, REALTOR® (eXp Realty) — Owned vs. Exclusive-Use Spots & Ontario Regulation 48/01.

Why Underground Parking Is a Decisive Resale Factor in Mississauga
Unlike Downtown Toronto—where many sub-500 sq. ft. studio and 1-bedroom condominiums sit directly on top of a TTC subway station and trade without parking—Mississauga remains a commuter city where over 80% of resale buyers and AAA tenants require at least 1 underground parking space.
In 2026, when builders in Square One / City Centre or Port Credit sell pre-construction suites, they frequently restrict parking purchases to units over 550 or 600 sq. ft. and charge $55,000 to $85,000+ (+ HST) for a single underground stall. On the TRREB MLS® resale market, understanding how parking and storage lockers are legally held on title—and what they are worth—protects your investment.

1. Deeded ("Owned") vs. "Exclusive-Use Common Element" Parking & Lockers
When Fernando Borges Mora, REALTOR® (eXp Realty) drafts OREA Form 101 (Agreement of Purchase and Sale — Condominium Resale) and your real estate lawyer audits the Section 76 Status Certificate, we verify how the parking spot and locker are legally registered in Ontario's Teranet Land Titles system:
- Deeded / Owned Unit (
Level A/B/C, Unit #with its own PIN): The parking stall and locker have their own separate Property Identifier Numbers (PINs) on title. You legally own the stall and can sell it separately to another unit owner in the building (subject to the Declaration). - Exclusive-Use Common Element: The parking spot is legally owned by the Peel Standard Condominium Corporation (PSCC), but the Condominium Declaration permanently assigns the exclusive right to use that specific stall to your residential unit. You cannot sell an exclusive-use parking spot separately from your suite, though it transfers automatically to your buyer when you sell the condo.
2. Crucial Declaration Rule: Can You Rent or Sell Your Parking Spot to a Non-Resident?
Almost never. Nearly 100% of Peel Standard Condominium Corporation (PSCC) Declarations in Mississauga contain a strict building security covenant stating that a parking unit or storage locker may only be leased, licensed, or sold to an owner or registered occupant/tenant residing within the exact same condominium corporation!
- If you try to rent your unused Square One parking spot on Kijiji to a commuter who does not live in your building, Property Management will deactivate the garage fob and fine/charge back legal enforcement costs to your unit. However, you can legally rent your spare parking spot on the building's internal resident bulletin board/portal to a neighbour in your building for $150 to $225/month!
3. Ontario's EV Charger Condo Law (O. Reg. 48/01 Sections 24.2 to 24.6 — The 60-Day Rule)
Driving a Tesla or electric vehicle in Mississauga? Under Sections 24.2 to 24.6 of Ontario Regulation 48/01 under the Ontario Condominium Act, 1998, condominium owners have strong statutory rights to install an Electric Vehicle Charging System (EVCS) in their parking space:
- Mandatory 60-Day Board Response Window (
Section 24.5): Once a unit owner submits a complete written EVCS installation application (including electrical load drawings at the owner's expense), the Condo Board must respond in writing within 60 calendar days (and notify the owner as soon as reasonably possible if any document is missing). - Strict Grounds for Rejection (
Section 24.4): By Ontario law, a Condo Board cannot arbitrarily reject an owner's EV charger application! The Board may only refuse the application if it obtains a written opinion from a qualified professional (such as an electrical engineer or Electrical Safety Authority [ESA] inspector) proving that the installation would:- Violate the Ontario Electrical Safety Code, Ontario Building Code, or another statute;
- Adversely affect the structural integrity of the condominium property; OR
- Pose a serious risk to the health and safety of individuals or damage to property (though the Board may require an alternative installation method/load-management device if the owner's proposed method causes an unreasonable cost or disruption to the corporation).
- Section 98 / Section 24.6 Written Agreement Registered on Title: Once approved, the owner and Condo Corporation execute a mandatory written agreement registered on title allocating the cost of installation, electricity sub-metering, maintenance, and insurance to the unit owner.
